パソコンなどのコピーマシンの普及に加え、P2P通信ネットワークによる音楽ファイルの交換が始まり、音楽など開放環境で利用されるデータ型コンテンツの著作権保護が極めて困難になってきている。従来は、コンテンツの権利者と利用者と仲介事業者の三者の間で利害対立があり、妥協の産物としての著作権保護策はそれら三者を満足させるものではなかった。そこで、本稿では、それら三者の既得権益の維持を前提に、慣れ親しんだコンテンツ利用文化を損なわない著作権保護策として「三方一両得モデル」を提案し、その具体的な実現方法を示すと共にその適用効果について述べた。

The exchange of music files by P2P networks began in addition to the diffusion of the copy machines such as a personal computer. Therefore, the copyright protection of data type content such as music which is used in the open environment has been in difficulty. In this paper, "a business model of which three interested parties get profits together" is proposed as a copyright protection plan, and describes the method which realizes it, and the effect on its application.
