Abstract

This document introduces an example of an international standard for refugee status determination (RSD), the AJ decision made by the Immigration and Protection Tribunal in New Zealand. The appellant from China alleged that, “he feared persecution in China based on his Falun Gong activities.”Despite his low status in Falun Gong, the Tribunal determined a real chance of persecution if he returned to China referring to evidence gathered from his country on Falun Gong practitioners. He was granted a refugee status on grounds of imputed political opinion in New Zealand. The Decision-maker, Martín Treadwell, Deputy Chair of the Tribunal provided an overview of the case.
