抄録

This paper attempts to establish basic principles to evaluate environmental policy, based on Old Institutional Economics. Old Institutional Economists, such as Thorstein B. Veblen, John R. Commons, and Ezra J. Mishan, have emphasized the importance of vested rights, and analyzed how vested rights affect the establishment or change of public policy. Because vested rights are formally protected by the government, they have more political power and can regulate other actors. In fact, an actual environmental policy is more or less regulated by vested rights and past policy failures. Thus, we need to establish new basic principles of environmental policy, in order to evaluate how vested rights have an impact on the establishment or change of environmental policy.
