抄録

The Statute of the International Court of Justice(ICJ)does not include any provision when a State Party fails to comply with its judgments. Instead, under Article 94, Paragraph 2 of the United Nations Charter, a State Party may take recourse to the Security Council and the Council may take any action on the enforcement of judgments of the Court. However, this system has rarely been invoked so far and the Council has never employed its Article 94, Paragraph 2 powers. Nevertheless, it is said that the States Parties have generally complied with the judgments of the Court. That is because they assume the obligation to comply with its decisions when States agree to submit their dispute to the Court. Can this really be so? In practice, it is not easy to decide whether compliance has really taken place or not. Actually, in recent years, some States tend to bring cases before the Court regarding previous judgment of the Court. Focusing on some recent practice, this paper analyzes the current situation and some problems of the Court regarding compliance with its judgments. As the principal judicial organ of the United Nations, the Court may continue to play an active and flexible role for overall peaceful settlement of interstate disputes. Flexible commitment of the Council is also expected for prompt compliance with the judgments of the Court.
