Abstract

Radioactive substances such as thorium and uranium are often produced during the refining processes of rare earths. If the radioactive wastes thus generated are not managed properly, it could lead to radioactive contamination and health hazards. One of the worst cases of radioactive contamination was the Asian Rare Earth (ARE) Incident that took place in the Perak Province of Malaysia during the late 1970s and 1980s. In a legal battle that followed, the plaintiffs lost the case. Thus, questions of causal relationship and who is responsible for such hazards have been left unsolved. Further, an Australian mining company, Lynas Co., Ltd., has started operating its newly built rare earths refinery in 2012 in the Pahang Province of Malaysia. The Japanese government has provided a loan facility of US$ 200 million for this project. However, the company has been criticized by IAEA and several research institutes for serious deficiencies in its permanent waste disposal facilities and so on. Thus, the anxiety among the nearby residents has become enormous. This study examines the history and the status-quo of the ARE Incident. It also reviews the environmental and social impacts of the Lynas factory.
