本論文の目的は, 「少年犯罪が凶悪化している」という通念を批判的に検討することにある。とりわけ,犯罪の「質」の問題に焦点を当てることにより, この通念に対する反論をおこなう。現在, この通念は, 社会一般に広く信じられているものである。しかし, この通念が必ずしも少年犯罪の実態を反映したものでないことは, 多くの研究者が指摘している。例えば, 犯罪統計で見る限り, わが国の少年凶悪犯罪の数は, 1950～60年代には現在よりもずっと多かったのであり, この時期に比べれば, 現在の数値はおおむね低い水準で推移している。しかし, このような統計データに基づく議論には,一定の限界がある。「少年犯罪が凶葺化している」という主張がなされる場合, 犯罪の量的な増加だけでなく, 犯罪の質的な変化についてもしばしば言及されているからだ。すなわち, 近年の少年凶悪犯罪は, その手口や動機において, かつての少年犯罪にはなかった「凶悪な」特徴が見いだせる,というものである。この主張に対して, 統計データに依拠する従来の犯罪研究は, 十分に反論しえない, と思われる。以上のような状況をふまえ, 本論文では, 1950～60年代のわが国における代表的な少年犯罪の事例をとりあげ, その内容について検討をおこなう。そして, その検討により, かつてはなかったとされる少年犯罪の特徴の多くが, 1950～60年代においてすでに存在していたことを明らかにする。これにより, 「少年犯罪が凶悪化している」という通念が, 質的変化の観点からも妥当ではないことを示す。

The purpose of the paper is to critically examine the generally-accepted idea that "juvenile crimes are becoming crueler." Especially, an objection to the idea is carried out by focusing on the "qualitative" problems on such crimes. Presently, the idea is publicly and generally believed. However, many researchers pointed out that the idea does not necessarily reflect the actual circumstances of juvenile crimes. So far as seeing from the statistical data of crimes, for example, the number of Japanese juvenile cruel crimes has been much larger in 1950s and 1960s, and the present values are generally kept in the lower level than such decades. Nevertheless, the discussion based on such statistical data is limited. When a view that "juvenile crimes are becoming crueler," it often refers to also the qualitative changes of such crimes not only to the quantitative increase of crimes. Namely, such view points out that these methods and motives show the "cruel" characteristics that could not be seen in the past juvenile crimes. Conventional crime studies based on statistical data are considered not to be able to sufficiently make an objection to such view. In the above circumstances, this paper takes up typical Japanese juvenile crimes in 1950s and 1960s to examine the contents. And the examination reveals that many of the juvenile crime characteristics, that are generally believed not to exist in the past, have already existed in 1950s and 1960s. Consequently, the idea that "juvenile crimes are becoming crueler" is not appropriate also in the viewpoint of qualitative changes.
