Abstract

This paper tries to clarify the legal structure of personal social services normatively by  focusing on the public responsibility. At present when the principal way of using personal social  services has been changed to one through the contract and voluntary mutual aid among local  community residents as the “integrated community care system”  have been focused, the  positioning of social welfare laws is not satisfying in the academic discussion on the legal structure  of the social security law based on placement into the institutions so far. This paper firstly  interprets the personal social service as a public intervention system to support the social  participation of individuals, and secondly proposes a new legal system which consists of “welfare  benefit law” ,  “welfare regulation law”  and “welfare support law” . Since the “fundamental structure  reform of social welfare”  around the year of 2000, in addition of “benefit law”  and “regulation law”   for direct benefit and regulation by the administration, “support law”  has been focused for indirect  support through information provision, social work, cultivation of human resources, local plans etc.  The “welfare support law”  can be summarised as a legal system for securing service-use to help  individual service-use through contract, to establish local provision, and to secure administrative  decision process for service-use.
