Abstract

This paper explores a possibility of application of the relational rights theory to the social security law as a legal right theory based on the ethics of care using the discussion on the UK care laws. First, when we think of care as a relational activity, it is important to focus on benefits and supports to carers. Second, when the decision of medical treatment is made in the caring network, it is necessary to establish a system to support a decision making by carers. Third, when regarding a family as a unit for caring relationship, it is not necessary to regard marriage as heterosexual relationships with consummation nor parenthood as biological links but as caring relationships. Fourth, for workers with caring responsibility, a system to combine paid work with care is required.
