Abstract

On 12 July 2016, The South China Sea Arbitration declares that China has breached its obligations under Articles 123, 192, 194(1),194(5), 197 and 206 of UNCLOS, finding that China has not cooperated or coordinated with the other States bordering the South China Sea concerning the protection and preservation of the marine environment concerning such activities as land inclamation and construction of artificial islands, installations. and structures. This article analyzes the legal character of Article 123 of UNCLOS on the duty to cooperate of States bordering enclosed or semi-enclosed seas.
