Abstract

本論文は,「契約とは何か」という点をめぐる哲学や法学,社会学における議論を整理し,それをもとに,組織と個人の雇用契約に関わるこれまでの研究を捉えなおすことを目指す.具体的には,契約をめぐる哲学,法学,社会学の議論をもとに「自由主義的契約」と「関係主義的契約」という契約観の理念型を導出し,そこに雇用契約に関する2つの研究群──契約の経済学と心理的契約──をあてはめることで,こうした研究の特徴と偏りを明らかにする.

The purpose of this paper is to examine the concept of contracts from perspectives of philosophers, lawyers and sociologists and to reconsider our view of employment contract as management theorists. Firstly, in reviewing of these fundamental disciplines, the paper classifies researchersʼ view of contracts into the following two categories: Liberaloriented contract and relation-oriented contract. Secondly, the paper evaluates existing researches on employment contract from perspectives of these two categories. Lastly, the paper examines characteristics and bias shown in the previous researches.
