Abstract

In economically matured society like Japan, an effective cost-recovery system from private companies regarding public infrastructure development is essential. This paper aims to analyze the new ground exploitation system under the New Spatial Act 2008 in the Netherlands. The Netherland introduced the compulsory ground exploitation plan, which asks for private companies to contributions. In practice, under the possibility of making a ground exploitation plan, a municipal government and private companies negotiate for a ground exploitation agreement based on the structure plan, which decides effective contributions or other private burdens. The Dutch system has three strong points for essential to cost-recovery system; plan rationality, flexibility and legal-effectivity. This system would be informative to Japanese cost recovery system design.
