The question of the consequences of breaches of international law is only now beginning to attract the attention it deserves. This book deals with one aspect of that wider question: it is the first comprehensive study of judicial remedies in international law. The author investigates the early development of judicial remedies through the varied practice of international arbitral tribunals; the diversity of these decisions makes it doubtful whether such tribunals ever evolved any consistent rules governing judicial remedies. The significance of the contributions made by the Permanent Court of International Justice, its successor the International Court of Justice, and specialized tribunals such as the European and American courts of human rights and the United Nations administrative tribunal is then evaluated. The pronouncements of these courts and tribunals on damages and restitution in integrum, on satisfactions, and declaratory judgments raise basic questions: are there any general principles underlying judicial remedies? Are remedies derived from municipal legal systems necessarily suitable at the international level? Readership: legal scholars, practising international lawyers, government legal advisers and advanced students of International Law.
