The objective of this text is to provide a foundation for developing practical skills in cross-examination, an integral part of criminal advocacy. Cross-examination is seen here not in isolation, but as a part of the entire trial process, distinguishing its constructive and destructive functions. Challenging the witness and the evidence are factors considered separately, in detail. Emphasis is placed on the importance of contradicting evidence by other evidence in support of destructive cross-examination. The context of the trial is explained, including the nature of the real issues of fact, how errors arise in testimony and the various forms of deception which play a major role in criminal trials. The text studies cross-examination by either the prosecution or defence counsel and solicitors in both jury and summary trials. Although intended primarily for those engaged in criminal advocacy, this book should also be of benefit to police officers who are regularly subjected to vigorous cross-examination, expert witnesses, doctors, psychiatrists, forensic scientists, psychologists, social workers and journalists.
