This is the first detailed study of the Scottish law of personal insolvency to be published for more than 70 years. It examines the new legislative code as proposed by the Scottish Law Commission and now embodied in the Bankruptcy (Scotland) Act 1985. It looks at the role of the various personnel involved in the administration of a bankrupt's estate - trustees and commissioners as well as other judicial factors. The emphasis is on practical application of the legislation and special topics such as deceased debtors, voluntary trust deeds and extra-judicial composition contracts are also considered.
