The harm caused by defective products can be devastating and widespread - in some cases involving major litigation. The question of who is liable for the loss or damage is of interest to both academic and practising lawyers. The area has recently been the subject of legislation of which full account is taken in this new study, in particular "The Consumer Protection Act 1987" which came into force in March 1988 and implements the EEC Directive on product liability. The author examines in depth the basic concepts and nature of liability, the types of loss covered and the defences permitted, including "state of the art" or "development risks" - both important and controversial topics. The policy issues and choices involved are canvassed, and instructive comparison are made with other jurisdictions, notably the United States.
