Based on an empirical enquiry into the operation of the tribunal system, this study explains how decisions are made under the Mental Health Act 1983, from the initial application by a patient, through descriptions of tribunal hearings, to an examination of their deliberations. The author looks at individual cases and attempts to elucidate the how and why of decisions to discharge, and to explain the inherent limitations of legal safeguards functioning in therapeutic contexts.
