Since they became law in 1981, the "Transfer of Undertaking" regulations have attracted considerable academic and judicial attention. In this book Fraser Younson presents a practical guide to the regulations, their implications for both employer and employee, the pitfalls they throw up and how to avoid them. The author examines the historical background against which the regulations were passed and how they have since been interpreted by the Courts. By reference to specific case law and practical examples he brings his considerable experience as a lawyer working in employment law to bear in analyzing the law and suggesting possible gaps in the legislative framework. The author places his analysis in its practical context, suggesting the information to be gathered, the questions to be asked, and the decisions to be made by both vendor and purchaser. In addition the book has a useful appendix of statutory materials and checklists for the practitioner.
