Description

The concepts of ownership and possession are difficult and not well understood. Both academic and practising lawyers found the first edition of this book beneficial because of its original treatment of the acqusition and loss of proprietary rights under contracts of sale. In the new edition of "Proprietary Rights" the text has been revised, expanded and updated to include recent developments in the field. The author has enlarged the treatment of the legal effect of commingling of goods, including an examination of the recent decision of the Court of Appeal of New Zealand in "Coleman v. Harvey". He has also re-examined the effectiveness of "Romalpa" clauses in the light of further case law and analyzed the impact of an administrative petition and order under the "Insolvency Act 1986" on the enforcement of rights under retention of title agreements.
