This is an analysis of a key dilemma in the feminist politics of law - should feminists continue to appeal to rights? In a series of essays Elizabeth Kingdom explains why an invocation of rights will not necessarily advance feminist politics and might even hinder them. She shows how the traditional theoretical concept of rights acts as a barrier to feminist objectives, particularly in relation to abortion, sterilization and co-habitation contracts. Yet despite this, she argues that feminists should not abandon rights-talk altogether. Using feminist responses to a proposed UK Bill of Rights shows that there can be no all-or-nothing strategies about rights in the feminist politics of law. This book aims to take a fresh look at ways of thinking about feminist interventions in legal issues by analyzing the limitations of appealing to rights in order to achieve feminist goals in law.
