This edition examines the statutory rights of dismissed employees, with particular reference to offers of re-engagement or alternative employment and dismissals connected with industrial action. There is also discussion of the common law principles of wrongful dismissal and dismissals under public law, both accompanied by an explanation of the available remedies, with sample calculations of compensation. Finally, there are procedural considerations, such as limitation periods and remedies against insolvent employers. The subject matter of termination is set against the general background of employment law so that many practical points are addressed, together with issues such as compulsory retirement ages for men and women, frustration of contracts and the implications of the increased use of fixed-term agreements.
