Studies of partisan realignment in America most often focus on the effects on the electorate and on Congressional policymaking. Less is known about the effects of realignment on judicial policymaking. In the longstanding debate over whether the Supreme Court uses its power of judicial review to legitimate or the oppose the political agenda of the new majority party, this book brings an array of data, involving 743 cases between 1837 and 1964, to bear on the dispute. In combination with historical and interpretive analysis, this study aims to improve understanding of the connections between Supreme Court policymaking and the process of realignment.
