Description

"Arbitration in Spain" is designed for two audiences: students of arbitration and practitioners. To some extent the two have different needs, and this book tries to satisfy the requirements of both audiences. For example, many of the contributions provide insight into the parliamentary discussions and proposals which took place at the time when the law was being debated in Congress, and thus offers an historical perspective for the student or arbitration. For the practitioner the book provides a step-by-step approach to the intricate world of Spanish arbitration. Accordingly, a number of Spanish legal scholars were approached and asked to contribute to this book. Each was asked to address a specific area of the law based on his/her experience with arbitration and/or with his/her experience in drafting the law. This book on the new Spanish arbitration law is also intended to clear up some of the ambiguities of the new law; there are some occasions where a literal reading of the law seems to advocate a position which is contrary to international arbitration practice. The scholars have identified those instances and have resolutely confirmed that the pursuit of international arbitration under the new law will not be at variance with international arbitration practice. The book is organized in the same order as the arbitration law and proceeds through the articles from first to last.
