This book provides expert analysis of the current state of world patent law and how it will develop. It contains an article-by-article discussion of the text of the Basic Proposal for a WIPO Patent Harmonization Treaty, including the full text of each article, followed by detailed explanation and comparisons with European, Japanese and US law. It also provides an analysis of the various schools of thought on harmonization, including a detailed look behind the views of the US and Japanese industries and negotiators offering, to the European reader in particular, key insights into the Pacific patent that may emerge should the Geneva negotiations in July 1993 stall; and scenarios for the possible success or failure of the various harmonization initiatives - both at Geneva and in the separate and parallel interest-groups in Europe, Japan and the US, as well as the developing world. The first publication of the author's proposal for a Patent Worksharing Treaty based upon points in a trilateral European-Japanese-American arrangement is also included. Among the issues given detailed attention in this book are the prospects for: automatic publication of patent applications for 18 months; assignee filing without oaths; biotechnology process claims; an opposition system in re-examining clothing; a relaxed examination standard for working examples; an optional utility model registration system for most subject matter; a tightened "yoshi" standard for post-filing amendments; and a more American style of compact prosecution including continuations.
