Custodianship is a form of guardianship which allows children being looked after by relatives, step-parents or foster carers to have stability without severing relationships and legal links with their birth parents. This research paper examines the use made of custodianship in England and Wales, aiming to obtain an accurate picture through national court statistics, a postal survey of all social services departments, and an in-depth investigation of all cases in progress during 1988 in four local authority social service areas. The investigation involved interviews with social workers, custodianship applicants and some birth parents and older children. It gives the background to custodianship, looks at local authority procedures and practice and highlights some of the legal difficulties experienced by the applicants.
