Description

Tort is almost always presented to students as apolitical; this book, however, is polemical. It provides a significant counterblast to those many and orthodox texts which take the so-called "common-sense" view of tort for granted. The authors argue that there can be no dispassionate account of the law of torts because the very foundation of tort reflects a particular economic ideology. This book complements established student tort texts with a critical analysis of tort and especially negligence, both on its own terms and from an external perspective. It calls into question the objectivity of current teaching on the subject.
