The basic duty of a banker to have close regard for the customer's right to confidentiality in his financial affairs is upheld in all jurisdictions, but the legal position of banks varies from country to country. In Switzerland disclosure is a criminal offence strictly enforced, whereas in Italy even the civil duty of non-disclosure might sometimes be less than keenly observed; under U.S. law, bankers are in peril of punishment in their own jurisdictions if they disclose information, and punishable for contempt in the federal court if they do not. In this book the positions of a number of jurisdictions are the subjects of lively and varied discussion by 12 contributors.
