This text explains the general legal principles which govern the Joint Contracts Tribunal Standard Form of Building Contract. Dealing with the implications of the relationship between employer and an architect or surveyer, it then looks at the contractual position of employer and contractor. Coverage has been given to the content of building contracts, contractors' obligations, employers' obligations, contract formation, sub-contractors and suppliers, and contract disputes. Guidance is given on the various procurement methods which can be adopted and the range of standard-form contracts applicable to each type of project. The treatment also covers issues in construction law such as: alternative dispute resolution; the defence of set-off; letter of intent; determination clauses. There is a chapter looking at how building contracts disputes can be resolved through non-litigious channels eg through arbitration and the text illustrates how general legal principles govern the most common used forms such as the Joint Contracts Tribunal Standard Form of Building Contract.
There is also advice on the appropriate form of contact for any particular type of project and coverage of contractual problems practioners may fact.
