This textbook outlines the basic principles of equity and trusts in the UK and other jurisdictions where relevant. The nature, purpose and operation of the various forms of trusts, together with their function and significance, are considered from the differing viewpoints of the settlor, trustee, beneficiary and Chancery Court. Attention is given to the application of more detailed rules to the core principles, with the aim of ensuring a greater understanding of the subject. New additions to the text include the impact of the Charities Act 1992 and the development of the informal acquisition of equitable interests in the home for cohabitees. Also, the new stricter liabilites imposed on third parties involved in dishonest breaches of fiduciary duty are discussed in light of the latest defence of change of position. This text should be suitable for students on degree level courses.
