Practitioners requiring information and guidance - both of an authoritative and practical nature - to the law and practice of rights of way should turn to Garner's Rights of Way.
Given the conflicting nature of property ownership and rights of others over that property, there is much scope for disputes and litigation in respect of the protection or abuse of such rights. Garner's explains clearly how rights of way are created, who is then responsible for them, when to record them and how to get them revoked.
There has been considerable legislative changes to this area of law since the last edition was published in 1989, including the Rights of Way Act 1990, the Planning Acts of 1990 and the Access to Neighbouring Land Act 1992. This edition of Garner's covers all of these changes as well as key case law practitioners need to be aware of, including: Attorney General (ex rel Yorkshire Derwent Trust Ltd) v Brotherton (1992) and R v Secretary of State for the Environment, ex p. Simms (1990).
