The commercial diffusion of the information held by the public sector is a phenomenon in full extension. The Commission of the European community has issued "Guidelines for improving the synergy between the public and private sectors in the information market" to direct the Member States when defining their policy for the diffusion of public sector information. This text presents a study of the different legal factors intervening in the commercialization phenomenon.
