内容説明
The purpose of this book is interdisciplinary evaluation of the issue of economic analyses in EC competition law. Although the book is clearly written for a legal audience, economics are introduced by the theme. The book integrates both disciplines - law and economics - in such a way that economics in competition proceedings become easier to understand for people who are not trained in economic theory. The scope is on Articles 85 and 86 and the Merger Regulation because those are the EC competition rules applying to businesses. The general content of the book is as follows: in Chapter II the competition rules are presented in a comprehensive way with the aim of preparing the scene, followed by Chapter III on competition theory. The concept of competition is developed from an economic point of view because knowledge about economic theory becomes essential in EC competition law. The third part is the most critical one because it proves that the role of economic analyses needs to be adapted according to the emerging new approach, which is highlighted by analyzing judgements of the EC Courts and, for example, the Commission's Green Paper on Vertical Restraints.
This fourth chapter also gives some guidance on how to apply an economic analysis. The chapter on competition theory, which is written in such a way that lawyers are able to understand the topic, the evaluation of the increasing importance of economics in competition law, and the guidance for dealing with this subject, should be of practical use.
