Description
Exploring the Law emphasises the importance of the core elements of precedent and statutory interpretation and portrays such elements as integral and vibrant parts of the law rather than as abstract concepts. Case studies are used to link the mechanics of precedent and statutory interpretation with substantive law. Two types of case studies are used: one focuses on individual cases illustrative of certain aspects of precedent and statutory interpretation, whilst the other shows how legal rules develop through judicial decisions and/or legislation. Each case study, whilst self-contained, is closely linked to the section on general principles through extensive cross-references. This edition contains a new section on the Human Rights Act 1998 and additional case studies on false imprisonment/unlawful detention and the Mental Health Act 1983, and undercover police operations.
