An exploration of the enduring powers of attorney. It explains the purpose of an enduring power of attorney and the circumstances in which one may be useful when dealing with a mentally incapacitated client. It also sets out the procedure for obtaining an enduring power, outlines the duties and responsibilities of an attorney and contains all relevant legislation and prescribed forms. This fifth edition has been updated and expanded since the publication of the fourth edition in 1996. In particular, significant developments such as the introduction of the Court of Protection (Enduring Powers of Attorney) Rules 2001 and the closure of the Public Trust Office and the transfer of its mental health work to a new body, the Public Guardianship Office, are discussed. Two new chapters are included, dealing with trustees and financial abuse, and full text reports of five leading EPA cases are covered. New Law Society Guidelines on Enduring Powers of Attorney are also reproduced.
