Description

There is nothing more important to a barrister's practice than a sound knowledge of the principles of professional conduct and an ability to apply them. In its "First Report on Legal Education and Training" (April 1996) the Lord Chancellor's Advisory Committee onLegal Education and Conduct identified "The Ethical Challenge" as one of the foremost challenges to the future education and training of lawyers. This manual provides the materials and practical guidance with which intending barristers can begin to meet the ethical challenge. It includes the full text of the Code of Conduct for the Bar of England and Wales with which all barristers must be familiar. By isolating, analysing, and encouraging students to apply the provisions of the Code the Manual gives a grounding in what might be called "traditional" or "vocational" professional conduct. In addition, the manual looks at professional conduct issues in a broader ethical context. It includes the summary of the Equality Code for the Bar, extracts from the Lord Justice Brooke on "Treating People Fairly", and from Barbara Hewson on "Harrassment: Law and Professional Ethics".

Description

Your understanding and application of the principles of professional conduct are crucial; they represent the foundation of all that you will achieve at the Bar. This manual contains the necessary guidance and key practical texts that you will need to help you through these sometimes problematic areas of practice. The focus of the manual is on the development of your skills to deal efficiently with professional conduct matters. One aspect of your vocational training will be the application of the Code of Conduct of the Bar of England and Wales, and this manual contains the full Code and its Miscellaneous Guidance. Your understanding of professional conduct and ethics must however reach further than a simple familiarization with the Code of Conduct. This manual also discusses the broader ethical considerations that you will need to be aware of when working at the Bar today. You are encouraged to question the application of the spirit of the Code, when the solution cannot be found in any express provisions, and to think carefully about your personal morality to ensure that it does not interfere with your practice as a lawyer.

It includes full discussion of the letter and the spirit of the Code, together with the full and current text of the Code and annexes thereto issued by the Bar Council. The manual focuses particularly on building students' knowledge and application of the Code of Conduct; their understanding of the broader ethical considerations to be taken into account for working at the Bar today; and their awareness of potential professional conduct matters. It identifies a variety of the common difficulties encountered in practice and gives clear and helpful guidance on the correct approach. The manual also discusses broader ethical considerations relevant to those practising at the Bar. The reader is encouraged to question the application of the spirit of the Code when the solution to a particular problem cannot be found in any express provisions and to think carefully about his or her own personal morality to ensure it does not conflict with ethical conduct as a lawyer.
