Description
Rented housing makes up about one third of the housing market in England and Wales. A framework of statutory regulation to minimise the potential for exploitation in this sector has developed over the years which must be read alongside contractual tenancy agreements entered into by a landlord and tenant. This situation makes for a complex body of law, and the primary objective of this report is to address this lack of clarity. It sets out the Law Commission's recommendations for radical reforms of the rented housing sector, which seek to replace the historic linkage between principles of property law and housing legislation with a new approach based on contract, incorporating consumer law principles of fairness and transparency. Key principles of the proposals include provisions guaranteeing varying degrees of security of tenure, repossession obtained through due process before a court, emphasis on the rights and obligations of landlord and tenant, and compliance with human rights law.
