"Blackstone's Civil Practice 2005" provides authoritative expert description and analysis of the process of civil litigation in the county courts and in the High Court. It combines a unique narrative commentary with the full text of the Civil Procedure Rules, Practice Directions and Pre-Action Protocols and Practice Guides. "Blackstone's Civil Practice 2005" is the only civil court text to explain and analyse civil procedure in narrative chapters. Written by a team of expert practitioners and academics, the text follows the course of proceedings from funding litigation and commencement of a claim through to enforcement of judgements. The text offers lucid, practical guidance to the effective conduct of litigation - providing detailed guidance on both the general conduct of litigation, and more specialist areas such as judicial review, landlord and tenant and possession proceedings; sale of goods, and consumer credit. The narrative and materials have been updated in the light of CPR 38 and 39, all rule amendments to the Civil Procedure Rules up to 4 April 2005, and the steady flow of important new cases since the last edition.
The key developments include: new edition of the Patents Court Guide; provisions on civil restraint orders; revised practice for appeals in PD 52; new fixed success fee rules in road traffic and accident at work; conditional fee agreement claims; new court fees brought in by the Civil Procedure Fees Order 2004, SI 2004/3121; and, revised Personal Injury Protocol. Key new case law discussed in the book, includes: cases on legal professional privilege, notably the House of Lords decision in Three Rivers District Council v Bank of England; and, developments on interim injunctions, notably Cream Holdings v Banerjee on the inter-relation between injunctions to restrain a threatened breach of confidence and art.10 of the European Convention of Human Rights. The narrative is supported by procedural checklists, giving quick access to details of required actions, time limits and applicable Rules and Practice Directions. The text is also cross-referenced to comprehensive appendices containing a scrupulously edited and up-to-date text of the Civil Procedure Rules, Practice Directions, Pre-Action Protocols and Court Guides and selected procedural legislation.
All copies of "Blackstone's Civil Practice 2005" come complete with an individual user version CD-ROM, which is issued simultaneously with the bound book. The CD-ROM includes hypertext linking for, among other things, references to the Civil Procedure Rules and Practice Directions. The CD-ROM also includes all relevant forms. System requirements for CD-ROM: Intel[registered] Pentium[registered] - class processor or above; Microsoft[registered] Windows 98 Second Edition, Windows Millenium Edition, Windows NT[registered] 4.0 with Service Pack 6, Windows 2000 with Service Pack 2, Windows XP Professional or Home Edition, Windows XP Tablet PC Edition; 32MB of RAM (64 MB recommended); 4x CD-ROM drive or greater; 130MB of free hard disk space to install the CD-ROM to the hard disk; Internet Explorer 5.01 or above. We recommend that, where possible, you set your screen resolution to a minimum of 5VGA resolution (800 x 600 pixels) or higher when using this product. The book is also accompanied by a regularly updated companion web site.
