Description
Because the facts are so important and interesting in medical liability litigation, the authors of this law school casebook have selected cases with thorough statements of facts as well as intelligible discussions of law. The authors have avoided including medical and legal horror stories; instead, a good many cases illustrate commonplace situations in medical practice that lawyers have to discuss with doctors over and over. The medical practitioner orientation looks at negligence, informed consent, bioethics, and insurance through the eyes of doctors and other health care providers. The authors are not plaintiff-oriented or defendant-oriented; they are trying to show the interplay of lawyers and doctors in many roles.
