Lawyers should be problem solvers. In their introductory courses, however, those studying the law tend to read cases more and solve problems less. While reading of cases like Pennoyer, Erie, Hickman are essential to a Civil Procedure course, this book allows students to solve some problems while working through the legal doctrine. Based largely on cases, the book allows students to put Civil Procedure into context in Personal and Subject Matter Jurisdiction, the Erie Doctrine, Pleading (and Motions), Discovery, the resolution of the dispute, both through Trial and other methods, Preclusion and Appeal. By working through the eleven chapters of problems following their review of cases and the Rules of Civil Procedure, students will have a better understanding of what lawyers actually do; put the law's doctrine to use in resolving client factual disputes.
