This new edition provides extensive and systematic coverage of federal and state law governing consumer transactions. The book introduces students to the case law applying the common law, statutes, and regulations to automobile sales and finance, home mortgages, predatory lending, and other transactions. To enhance the students’ mastery of statutory analysis, it makes extensive use of problems.
The law has changed significantly since publication of the prior edition, including enactment of the Credit Card Accountability, Responsibility and Disclosure Act (Credit CARD Act) and the Dodd-Frank Act. The Sixth Edition of Consumer Transactions provides extensive coverage of this and other legislation, as well as recent developments in all the other areas of consumer law.
Material new to the Sixth Edition relates to
• restrictions on the practices of credit card issuers;
• the Bureau of Consumer Financial Protection, including the new prohibition against abusive acts and practices and the new rules on mortgage lending;
• additional treatment of payday loans and automobile title lending, yield-spread premiums, and dealer-participation (upcharges);
• credit reporting, unconscionability, and mandatory arbitration (Concepcion and its aftermath).
• the impact of debt buyers; and
• the use of imprisonment in connection with debt collection
To accommodate the new material, judicious deletions have enabled the book to remain at approximately 900 pages. The book is accompanied by a Statutory Supplement, and a Guide for Teachers will be available.
