Description
The 'droit de suite' or Artist's Resale Right became the law in Italy on 9 April 2006. The major art markets, United States, UK and France had already assessed the economic effects of this right. Almost four years after the law was passed, in Italy the 'Associazione Nazionale Case d Asta' decided to sum up the situation, engaging the University of Bologna to undertake the research, the first in Europe, which was carried out by experts in the economic, juridicial and business disciplines and then compared to the experience of art market operators. With accurate enquiries and statistic surveys, the research illustrates the different positions of those who deem the ARR an ineffectual instrument and those on the other hand who, in spite of the many problems involved in applying the law, claim that such a highly complex right (the present form of which is not considered definitive even by the European legislators) requires an implementation obtained by experiment, trial and error.
